Social Security Disability

If you are disabled and unable to work, it is good to know that the Social Security Administration provides two types of benefits to help meet your needs:

  • Social Security Disability is a federal program that pays monthly benefits to individuals who are disabled.  The Social Security Administration has a very detailed list of conditions that qualify, but in general, disability includes physical, emotional, and mental disabilities that prevent you from engaging in substantial, gainful employment for one year or more.
  • Supplemental Security Income (SSI) is a program available if you are totally disabled, and you have little income and assets. If you are disabled and your income and assets fall below certain federal limits, you can obtain SSI benefits even if you have very little or no prior work history. In some cases, even children can be awarded SSI benefits.

When legal assistance can help

While it is not absolutely necessary to use legal assistance to file for Social Security Disability benefits, the laws and requirements for filing can be daunting, causing delays or even denial of your claim. The attorneys at Dixon & Johnston, P.C. have 30 years of experience helping individuals file for Social Security Disability benefits.  They know how to present the details of your claim to provide the best chance that it will be accepted.

If the Social Security Administration has denied your claim, the experienced attorneys at Dixon & Johnston, P.C. will gather your medical and financial information and appeal your claim.  They understand why the claim was denied, and they will examine every possible measure to get the benefits you need.

You must act quickly

If you are filing an appeal for a claim that has been denied, you should get started as quickly as possible, keeping these two important points in mind:

  • Time limit on appeals: You generally have only 60 days to appeal a denied claim.  To ensure we have time to file a timely appeal, you must contact our office immediately after receiving notification of a denial.
  • Hearing date delays:  Hearing dates are generally scheduled for a year or more after you file an appeal.  Although it might occasionally be possible to accelerate the process, the system is generally slow, and there is very little that can be done to speed it up. However, when an appeal is successful, the benefits are generally awarded retroactively for the time you were awaiting your hearing.
