Understand complex Social Security Disability appeals

On Behalf of | Sep 27, 2019 | social security disability |

Social Security Disability income is the only way that some disabled individuals can support themselves. Filing for the benefits doesn’t mean that you will automatically get it, however. Instead, there is a good chance that you will receive a denial of benefits the first time that you apply.

This means that it is important to understand your right to appeal if your claim isn’t approved.

The first step in your appeals process is called a Request for Reconsideration. Once you file the request, your claim will be sent back to through the determination process for a new review, along with any updated medical information that you have.

While this is frustrating for many, it’s important to follow through with your appeal in a timely manner. Many good claims are denied for small reasons — like incomplete medical records or information. You may even be able to help your own appeal by contacting your doctors and requesting your own medical records to submit with your appeal or a letter regarding your limitations.

Take steps to protect your interests. If you’re having trouble getting your Social Security Disability claim approved, it may be time to talk to an attorney who can help with your appeal. An attorney can review your application, look at the reasons your claim was denied and help you strategize your appeal. Sometimes, something as simple as reorganizing your information in a way that is easier to digest is enough to get a claim approved. Other times, your attorney may need to directly combat the Social Security’s vocational assessment of your capabilities.
